These Terms & Conditions ("Terms") govern your use of PestFlap.com and any purchase, order, or enquiry made through it. By accessing this website, placing an order, or engaging with us as a trade or distributor partner, you agree to be bound by these Terms. If you do not agree, please do not use this website or place an order.

PestFlap.com is operated by Drainbo Ireland Limited, trading as PestFlap ("PestFlap," "we," "us," or "our"), a company registered in Ireland with a registered address at Clonlough, Mitchelstown, Co. Cork, Ireland.

• "Products" means PestFlap branded drain pest exclusion devices, including PF3 and PF4, and any related accessories sold via this website.
• "Retail Order" means an order placed by a consumer or business through the standard PestFlap.com checkout.
• "Trade Order" means an order or ongoing supply arrangement placed by a distributor, reseller, or trade partner, whether via the website's trade enquiry channel or a separate agreement.
• "You" means the person or business placing an order, submitting an enquiry, or otherwise using the website.

By placing an order, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and that all information you provide, including billing, shipping, and contact details, is accurate and complete. You are responsible for keeping any account or contact details up to date.

We make reasonable efforts to describe our Products, including dimensions, materials, and intended use, as accurately as possible on this website. However:

• Product images are for illustration and may vary slightly from the actual item.
• Specifications may be updated as Products are refined. Where a material change affects an existing order, we will notify you.
• PF3 and PF4 are drain pest exclusion devices and are not represented as certified plumbing, medical, or safety equipment unless explicitly stated.
• Some product names, features, or packaging may reference patent pending status. This reflects a pending application and does not guarantee grant of a patent.

Placing an order through PestFlap.com is an offer by you to purchase the selected Products. No contract exists until we accept your order, which we do by sending an order confirmation email or, for Trade Orders, by written confirmation. We reserve the right to refuse or cancel any order, including due to product unavailability, pricing errors, or suspected fraudulent activity. In such cases, we will notify you and refund any payment already made.

• All prices are shown in the currency displayed at checkout and are exclusive of shipping costs unless stated otherwise.
• We take reasonable care to ensure prices are correct, but errors may occur. If we discover a pricing error on an order you have placed, we will contact you before proceeding.
• Retail Order payments are processed securely by our third party payment processor at the time of order. See our Privacy Policy for how payment data is handled.
• Trade Order pricing, payment terms, including any credit terms, and minimum order quantities are agreed separately in writing or via invoice. Those agreed terms take precedence over this Section where they conflict.
• Taxes, duties, and import charges applicable to your location are your responsibility unless otherwise stated.

• We aim to dispatch orders within a reasonable timeframe using standard carriers. Estimated delivery times shown at checkout are estimates, not guarantees.
• Risk in the Products passes to you upon delivery to the address provided at checkout.
• Title to the Products passes to you once payment has been received in full.
• You are responsible for ensuring someone is available to receive delivery, or that delivery instructions are accurate. We are not liable for delays caused by incorrect address details.
• Trade Orders may be fulfilled directly by PestFlap or via an authorised distributor, as agreed at the time of order.

8.1 Retail Orders

If you are not satisfied with a Retail Order, you may return unused Products in their original packaging within 30 days of delivery for a refund or exchange. To start a return, contact support@pestflap.com with your order number. Return shipping costs are your responsibility unless the return is due to a fault or error on our part. Refunds are issued to the original payment method once the returned item is received and inspected.

This 30 day return right is in addition to, and does not affect, any statutory rights you may have as a consumer in your jurisdiction, for example EU or Irish consumer rights or applicable US state consumer protection laws.

8.2 Trade and Bulk Orders

Trade Orders and bulk orders are not covered by the 30 day retail return window. Returns, replacements, or credits for Trade Orders are handled according to the terms agreed in the relevant trade agreement, purchase order, or invoice, or, where none is specified, at our discretion on a case by case basis.

8.3 Faulty or Damaged Products

If a Product arrives faulty, damaged, or not as described, contact us within a reasonable time of delivery with your order number and a description, along with photos where possible, of the issue. We will arrange a replacement, repair, or refund as appropriate, at no additional cost to you, in line with applicable consumer law.

The PestFlap name, logo, product designs, website content, and related materials are the property of Drainbo Ireland Limited / PestFlap and its licensors, and are protected by trademark, copyright, patent, and other intellectual property laws, including one or more pending patent applications. You may not copy, reproduce, distribute, or create derivative works from any PestFlap materials, branding, or product design without our prior written consent.

Purchasing a Product gives you the right to use that Product for its intended purpose. It does not grant any licence to our intellectual property, including our designs, trademarks, or pending patent rights.

Where you engage with PestFlap as a distributor, reseller, or trade partner, the following applies in addition to these Terms:

• Any specific pricing, territory, exclusivity, minimum order, or branding arrangements must be set out in a separate written trade agreement to be valid.
• Distributors and resellers may not make claims about Product certification, patent status, or performance beyond what PestFlap has provided in writing.
• Use of the PestFlap name, logo, or product imagery in a distributor's own marketing requires our prior written approval.
• Nothing in these Terms creates a partnership, joint venture, franchise, or agency relationship between PestFlap and any distributor or trade partner unless expressly agreed in writing.

We warrant that Products will be free from material defects in workmanship at the time of delivery, subject to Section 8.3. Except as expressly stated in these Terms or required by applicable law, Products are provided "as is," and we disclaim all other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law. Nothing in this Section limits any statutory rights that cannot be excluded under applicable consumer protection law.

To the fullest extent permitted by law, PestFlap's total liability arising out of or relating to your order or use of this website is limited to the amount you paid for the relevant Product. We are not liable for indirect, incidental, or consequential losses, including loss of profits, business, or data, arising from your use of the Products or this website. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence, or fraud.

You agree to indemnify and hold PestFlap harmless from any claims, losses, or expenses, including reasonable legal fees, arising from your misuse of this website, breach of these Terms, or violation of any law or third party right.

These Terms are governed by the laws of Ireland, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of PestFlap.com will be subject to the exclusive jurisdiction of the courts of Ireland. If you are purchasing as a consumer resident outside Ireland, this does not affect any mandatory consumer protections available to you under the law of your own country of residence.

We may update these Terms from time to time to reflect changes in our practices, Products, or legal requirements. The "Effective Date" at the top of this page shows when it was last revised. Continued use of PestFlap.com or placement of an order after changes take effect constitutes acceptance of the updated Terms.
